Welcome to Lingala.cd! These Terms of Service ("Terms") govern your access to and use of the Lingala.cd website, mobile applications, and language learning services (collectively, the "Platform") operated by Bourdak Corporation ("we," "us," or "our"). Please read these Terms carefully before using our Platform.
1. Acceptance of Terms
By creating an account, accessing, or using our Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Platform. You must be at least 13 years old to use our services. If you are between 13 and 18 years old, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. If you are using the Platform on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

We reserve the right to suspend or terminate accounts that violate these Terms, are inactive for extended periods, or are involved in fraudulent activity. We may also require you to verify your identity before restoring access to a suspended account.
3. Subscriptions and Payments
Billing and Renewal
Premium subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your plan). By subscribing, you authorize us to charge your payment method automatically at the beginning of each billing period. Prices are listed in USD and may vary by region. We reserve the right to change pricing with 30 days' notice to existing subscribers.
Cancellation
You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of your current billing period—you will retain access to premium features until then. We do not provide prorated refunds for partial billing periods unless required by law.
Refund Policy
We offer a 30-day money-back guarantee for first-time premium subscribers. If you are not satisfied within your first 30 days, contact us at lingala@bourdak.com for a full refund. After 30 days, refunds are granted at our sole discretion and only in exceptional circumstances. Refund requests must be submitted within 7 days of the charge you are disputing.
Free Trials
We offer a 3-day free trial for new premium subscribers. Your payment method will be collected at signup but you will not be charged until the trial period ends. Unless you cancel before the trial ends, you will be automatically charged $9.99/month for the subscription. Free trials are limited to one per person and payment method.
4. Content and Intellectual Property
Our Content
All content on the Platform—including courses, lessons, videos, audio files, images, text, graphics, logos, and software—is owned by Bourdak Corporation or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content without our prior written permission.
Your License to Use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform and its content for your personal, non-commercial educational purposes. This license does not include the right to: resell or commercially use the Platform or its content; collect or use any product listings, descriptions, or prices; make derivative use of the Platform; download or copy account information for third parties; or use data mining, robots, or similar data gathering tools.
User-Generated Content
You retain ownership of content you create and share on our Platform (such as comments, forum posts, or study notes). By posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display that content in connection with operating and promoting our Platform. You represent that you have the right to share any content you post and that it does not violate any third party's rights.

WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses. We make no guarantees regarding the accuracy, completeness, or usefulness of any content, or that using our courses will result in any specific learning outcomes, language proficiency, or career advancement.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOURDAK CORPORATION AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.
8. Indemnification
You agree to indemnify, defend, and hold harmless Bourdak Corporation and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) any content you submit to the Platform.
9. Termination
We may suspend or terminate your access to the Platform at any time, with or without cause or notice, including for violation of these Terms. You may terminate your account at any time by contacting us. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Platform and updating the "Effective" date. For significant changes, we may also send email notification to registered users. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Platform.
11. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction. You agree to waive any right to participate in class action lawsuits or class-wide arbitration.
12. General Provisions
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right. These Terms constitute the entire agreement between you and Bourdak Corporation regarding the Platform and supersede any prior agreements. You may not assign or transfer these Terms without our prior written consent.
